Mutual recognition - Formal requirements

The Federal Office of Consumer Protection and Food Safety (BVL) particularly draws attention to the formal requirements for applications for mutual recognition of an authorisation from another Member State in accordance with Article 40 of Regulation (EC) No 1107/2009.

In order for the BVL to process applications for mutual recognition, the formal requirements laid down in Article 42 of Regulation (EC) No 1107/2009 must be met.

This applies in particular to the registration report of the reference Member State required in Article 42(1)(d), which must be submitted in full, i.e. including all parts of the assessment (Registration Report: Part A, all Part B, Part C), with the application.

In this regard, reference is made in particular to Table 2.5.7.2 from page 19 in the publication "Information on the application and documents to be submitted for applications for authorisation of a plant protection product and for extension of an authorisation in accordance with Article 33, Article 40 and Article 51 of Regulation (EC) No 1107/2009".

Background:

Over the last few years, the number of applications for mutual recognition has increased. In practice, it has been found that these applications often do not fulfil the requirements mentioned above.
