Equivalence Assessments will remain limited

Until further notice, the BVL will only accept applications for equivalence assessments if

  • Germany is the rapporteur Member State (RMS) for the active substance

or

  • the new active substance source is intended for a plant protection product in Germany (existing authorisation or Germany is zRMS in the ongoing authorisation procedure).

If this is not the case, applicants are advised to contact either the RMS of the active substance concerned or the zRMS in the zonal authorisation procedure.

Background

According to Article 38 of Regulation (EC) No 1107/2009, equivalence of a technical active substance is assessed by the Member State acting as the rapporteur for the active substance in question, (RMS), or by the Member State which is responsible for the product authorisation pursuant to Article 29 of Regulation (EC) No 1107/2009.

In the past, it was possible to submit an application for equivalence assessment to the BVL even if Germany was not the RMS for the active substance, or if the new active substance source was not intended for a plant protection product in Germany.

Please note that due to large numbers of applications for equivalence assessments at this time, we are unable to process within a reasonable time frame any applications which are not assigned to an authorisation procedure. Therefore, the BVL will not consider such applications anymore.

As the BVL has stated previously in another technical information of 22 July 2020 and technical information of 13 November 2020, equivalence assessments can only be offered in the cases mentioned above.
