Limitation on equivalence assessments until end of 2020

For the time being until the end of this year, the BVL will accept applications for equivalence assessment only if
- Germany is the rapporteur Member State for the active substance, or
- the new active substance source is intended for a plant protection product in Germany.
In any other case, potential applicants are advised to address the rapporteur Member State (RMS) of the active substance in question.
Background
According to Article 38 of Regulation (EC) No. 1107/2009, equivalence of a technical active substance is assessed by the Member State that acted as rapporteur for the active substance in question, (RMS), or by the Member State where product authorisation pursuant to Article 29 of Regulation (EC) No 1107/2009 has been applied for.
To date, applicants could ask the BVL for equivalence assessment even if Germany was not RMS for the respective active substance, or the new active substance source was not intended for a plant protection product in Germany.
Because of the great number of present applications for equivalence assessments not connected with an authorisation procedure, the applications can no longer be processed within an acceptable period of time. The BVL will therefore not accept any more applications until the end of 2020.
