National regulations

The EU Regulation concerning the placing of plant protection products on the market (Regulation (EC) No 1107/2009) has been in force in the Member States since 14 June 2011. Therefore, this Regulation does not need to be implemented in national law. However, a set of rules has been established at national level in addition to EU Community law for using and placing plant protection products on the domestic market. The German Plant Protection Act serves this purpose. For example, it stipulates the competencies of the authorities concerning the authorisation and monitoring of plant protection products. The Plant Protection Act underwent a thorough revision in February 2012 with the act for reorganising plant protection legislation.

The details are stipulated in ordinances. For example, the Plant Protection Use Ordinance contains banned uses and restrictions for plant protection products with certain active substances. The Plant Protection Products Regulation governs authorisation and approval procedures. The Plant Protection Ordinance Governing Specialist Qualifications stipulates which qualifications a person must have in order to either use plant protection products professionally or to deal professionally in plant protection products. The Regulation on Plant Protection Equipment stipulates the demands on equipment which is used to apply plant protection products. The Regulation on Aerial Application of Plant Protection Products governs the respective approval procedures.

Fees are charged according to the Plant Protection Fee Ordinance (valid until 30 September 2021).

A new Fees Ordinance comes into force on 1 October 2021. The Special Fees Ordinance of the Federal Ministry of Food and Agriculture (BMELBGebV) (valid from 1 October 2021) was published in the Federal Law Gazette. In accordance with the transitional provision in Section 7 BMELBGebV, the fee regulations in force until 30 September 2021 shall continue to apply to the collection of fees and expenses for chargeable services applied for or started before 1 October 2021 even if not yet fully completed.
